Michael Cardamone, Owner of Cardamone Law and Certified PA Workers’ Compensation Attorney, secured a significant victory on behalf of his client, an injured supervisor/field worker who sustained a serious and permanent shoulder injury that resulted in five surgeries. The litigation spanned a year and was very contentious.

The Employer denied the work-relatedness of the injury, forcing Cardamone to file a Claim Petition. Many depositions were taken, including fact witnesses from the Employer and two medical experts. Claimant was the only witness to testify live before the Workers’ Compensation Judge.

In her Decision, the WCJ found Cardamone’s client to be credible, in addition to finding Cardamone’s medical expert to be more credible than the hired “Independent” Medical Examiner. Cardamone’s cross examination of IME doctor revealed that he had a superficial understanding of the case and that he was equivocal in his opinions.

The victory nets Cardamone’s client well over $50,000.00 in past due wage loss benefits, plus an ongoing check at the max rate of $932 per week, plus interest, and past due and ongoing medical benefits. The WCJ also awarded reimbursement of Cardamone’s litigation costs of over $6,000.00.
